Parental & Legal Guardian Consent

Because the person using the Child Account is a minor, registration and contractual decisions relating to the service must be completed by a Parent or Legal Guardian.

This document records the Parent or Legal Guardian’s consent and authorisation concerning the Child’s use of the Platform.

• I am the Parent or Legal Guardian of the Child identified above, or otherwise have lawful authority to provide the required consent on behalf of the Child;
• the information I have provided is true and accurate;

I have authority to create a Child Account for the Child; and

I understand that DKK Publishing may request reasonable verification of my identity or authority where necessary.

I consent to DKK Publishing creating and maintaining a restricted Child Account for my Child.

I understand that I will create or approve the username and password used by the Child.

I understand that the Child Account is intended primarily for:

• creating stories;
• using picture-guided storylines;
• creating custom storylines;
• writing words and sentences;

accessing permitted Educational Aids; and

using other age-appropriate creative functions offered by DKK Publishing.

I understand that the Child Account is separate from my Parent Account.

I understand that my Child will not be given access through the Child Account to:

• my residential address;
• my payment information;
• my payment card information;
• my bank account details;
• my billing information;
• my royalty payment information;

my Parent Account password; or

other private Parent Account information not required for the Child’s use of the story creation system.

Subject to DKK Publishing’s Privacy Policy and applicable South African law, I consent to the processing of the Child’s personal information as reasonably necessary to provide the services I request.

This may include information such as:

• Child’s name;
• age or date of birth where required;
• Child Account username;
• story title;
• written story;
• sentences and words;
• story ideas;
• selected themes;
• custom story concepts;
• book information;

Author information; and

information reasonably necessary to produce and administer the Child’s book.

I authorise my Child to use the DKK Publishing Platform to create original stories.

I understand that my Child may:

• interpret illustrations;
• write sentences;
• create titles;
• develop storylines;

select preset themes; and

create original custom themes or stories.

I agree to take reasonable responsibility for reviewing the content submitted through my Child’s Account.

I understand that my Child should not intentionally submit:

• copied stories;
• copyrighted characters belonging to third parties;
• copied illustrations;
• unlawful content;
• defamatory content;
• hateful content;
• pornographic or sexually explicit material;

dangerous or illegal content; or

material that infringes another person’s rights.

Where I purchase a Create Your Own Story/Theme package, I authorise DKK Publishing to review the Child’s written storyline and create illustrations based upon that storyline.

I understand that illustrations represent DKK Publishing’s artistic interpretation of the written story.

I understand that I will have an opportunity to review applicable proofs in accordance with the package and approval process.

I authorise DKK Publishing to perform reasonable editorial and production work required to prepare the Child’s story for publication, including:

• spelling corrections;
• punctuation corrections;
• grammar corrections;
• formatting;
• page layout;

typesetting; and

reasonable technical adjustments.

DKK Publishing should not intentionally change the fundamental creative meaning of the Child’s story without appropriate Parent approval.

For custom story creation where proof approval is provided, I understand that I am responsible for carefully reviewing the proof before publication.

I will review, where applicable:

• Author name;
• title;
• story text;
• spelling;
• illustrations;
• cover;

layout; and

publication information.

Once I provide final approval, additional changes may result in additional production costs.

Where publication forms part of the package I have purchased, I authorise DKK Publishing to publish the Child’s completed book subject to the Child Author Publishing & Royalty Agreement.

I understand that publication may include:

• printed books;
• digital editions where offered;
• eBooks where offered;
• DKK Publishing website listings;
• retailer listings;
• distributor listings;

online marketplace listings; and

promotional catalogue listings.

Where an ISBN is applicable to the selected publishing package, I authorise DKK Publishing to submit information reasonably necessary to obtain and administer the ISBN and publication.

I understand that information associated with a published book and its ISBN may form part of publishing and bibliographic records.

I understand that the Child will be recognised as the Author of their original written story.

I understand that DKK Publishing will confirm whether my selected option is compatible with applicable publishing, ISBN and distribution requirements.

I understand that DKK Publishing does not claim ownership of the Child’s copyright in the Child’s original written story merely because DKK Publishing publishes the book.

The Child’s original written contribution will remain subject to the copyright provisions contained in the Child Author Publishing & Royalty Agreement.

I understand that separate intellectual property may belong to DKK Publishing, including where applicable:

• preset illustrations;
• custom illustrations created by or for DKK Publishing;
• cover artwork;
• templates;
• preset story themes;
• Platform content;
• Educational Aids;
• layouts;
• branding;
• website content;

software; and

other original DKK Publishing material.

Ownership and permitted use of these materials are governed by the applicable DKK Publishing agreements and policies.

I understand that DKK Publishing requires permission to reproduce, print, publish, distribute, display and market the Child’s written story in order to provide the publishing service.

The detailed licence is contained in the Child Author Publishing & Royalty Agreement.

I understand that agreeing to publication does not automatically transfer ownership of the Child’s story copyright to DKK Publishing.

I authorise DKK Publishing to market the published book through its ordinary marketing channels in accordance with the Publishing & Royalty Agreement.

This may include:

• DKK Publishing’s website;
• social media;
• online marketplaces;
• retailers;
• distributors;
• catalogues;

promotional materials; and

educational channels.

I understand that marketing does not guarantee any minimum number of sales.

My consent to publication of my Child’s book does not, by itself, constitute blanket consent for DKK Publishing to use photographs or videos showing my Child’s identifiable face for unrelated advertising campaigns.

Where DKK Publishing wishes to use an identifiable photograph, testimonial video, interview or similar media featuring my Child, additional consent may be requested.

I understand that DKK Publishing may publicly display:

• the book cover;
• illustrations contained in or taken from the book;
• the title;
• book description;

authorised Author name; and

reasonable excerpts or promotional previews

for purposes of marketing and selling the published book, subject to the Publishing & Royalty Agreement.

Where the Child’s published book qualifies for royalties, I understand that:

• the Child is the Child Author;
• royalties will be administered through the Parent or Legal Guardian;
• payments will not be made directly through the Child Account;

DKK Publishing may require banking, identity and tax information from me before making payments; and

the royalty calculation will be governed by the Child Author Publishing & Royalty Agreement.

I understand that all purchases relating to the Child’s account must be made by me or another authorised adult.

My Child is not authorised to access my payment information or independently purchase packages through the restricted Child Account.

Where Educational Aids are included with a paid package, I authorise my Child to access those materials subject to DKK Publishing’s Terms and Conditions.

I understand that Educational Aids are intended for permitted personal educational use and may not be resold or commercially redistributed.

I consent to DKK Publishing communicating with me concerning:

• my Parent Account;
• the Child Account;
• purchases;
• story progress;
• illustrations;
• proof approval;
• ISBN administration;
• printing;
• delivery;
• publication;
• sales;
• royalties;

security; and

customer service.

Marketing communications will be handled separately where applicable.

I confirm that I have been given access to DKK Publishing’s Privacy Policy and POPIA Notice.

I understand that it explains how Parent and Child personal information is processed.

I understand that I may contact DKK Publishing concerning withdrawal of consent where processing depends upon my consent.

I understand that withdrawal of consent:

• may prevent DKK Publishing from continuing to provide certain services;
• does not automatically invalidate processing that lawfully occurred before withdrawal;

may not require deletion of records DKK Publishing must retain by law; and

may not automatically remove copies of books already lawfully printed, purchased, distributed or held by third parties.

Requests concerning withdrawal of a published book are governed by the Child Author Publishing & Royalty Agreement.

I understand that I remain responsible for appropriately supervising my Child’s use of the Platform.

I agree to take reasonable steps to ensure that:

• the Child keeps login credentials secure;
• the Platform is used for its intended purpose;

inappropriate content is not deliberately submitted; and

DKK Publishing is informed if I become aware of unauthorised access.

I agree that my affirmative electronic acceptance of this document may be recorded by DKK Publishing as evidence of my consent.

DKK Publishing may record information including:

• Parent Account identifier;
• date;
• time;
• document version;

acceptance status; and

reasonable technical information necessary to maintain an audit record.

I acknowledge that my use of the service is also subject to applicable versions of:

• Terms and Conditions of Use;
• Privacy Policy and POPIA Notice;
• Child Author Publishing & Royalty Agreement, where publication applies;
• Copyright, Intellectual Property & User Content Policy;

Refund, Cancellation, Production & Delivery Policy; and

Website, Cookie & Electronic Communications Policy.

By signing below or selecting “I Agree and Give Parental/Legal Guardian Consent”, I confirm that:

• I have read this consent;
• I understand it;
• I am legally authorised to provide the required consent for the Child;
• I consent to creation of the Child Account;
• I consent to the Child using the story creation Platform;
• I consent to the processing of the Child’s information for the purposes described;

where I purchase a publishing package, I authorise DKK Publishing to prepare the Child’s book for publication subject to the applicable agreements; and

the information I have supplied is accurate to the best of my knowledge.
